KAMIND Associates, Inc. is doing business as KAM Industries. KAM supports confidentiality of its users. KAM does not sell or supply user information to third parties except to KAM authorized dealers to fulfill KAM product questions. The trainpriority.com terms and conditions are listed below. These terms and conditions are subject to change at any time and without notice. All Information contained on trainpriority.com is a copyrighted and is protected under law. Changes to our usage policy may be updated at any time.

By purchasing any KAM product (dealer, retailer or via our web site) or by using this site in any fashion, you have agreed to our terms and conditions which includes the following: privacy policy, demonstration software policy, license/use agreement, trademarks, patents, product purchase/return policy, and our site usage/warranty policy.

Demonstration Software Policy
• All evaluation software operates for a one time use evaluation period. At the end of the evaluation period you must either purchase the software or remove it from your system.



• Software on this site contains technology covered by US and International patents and registered copyrights and trademarks. The intellectual property is listed on trainpriority.com web site pages.



• By subscribing (Sign In) to this site and downloading software sample programs you acknowledge that you have read and agreed to the terms and conditions on this site and agreed to our privacy policy.

Product Purchase and Return Policy
• If you purchase a KAM software product, that product is a single user product. Additional software licenses may be purchased from KAM and our online store.



• Some products have an activation period and require you to active the software after purchase. Your license to use product terminates if the software is not activated within the activation period. No refunds will be issued for inactivated product where shrink wrap has been opened.



• Product serial numbers are issued for purchased product and are registered to you. Serial numbers are not transferable.



• Your serial number allows you to install the number of copies that you have purchased, and allows you access to subscriber areas of our web site.
  
  
• If you install additional copies of software not covered by your purchase, you will be required to pay for those purchases. KAM reserves the right to bill you for those additional copies.



• All purchases from the web site are final purchases. No refund will be offered. If you are unsure of your purchase, try a download demo. Demo versions are full function.



• All purchases through a dealer (or retailer) may be returned only if package has not been open (or used). All returns must be received by KAM within 30 days after purchase and have a valid Return Material Authorization (RMA) from KAM. Product returned with invalid RMA will be rejected.

License Agreement and Trademarks
• Supplied source code, program examples, technical documentation may be freely incorporated into KAM's customer’s products, provided that the product uses KAM's Train Server as the controlling interface to the Model railroad.



• KAM technology, patents, trademarks, and copyrights are licensed products and are only for use with software developed and distributed by KAM and may not be used for any other purpose without having a written and signed agreement from KAM. All rights reserved. All other marks are the property of their respective companies and subject to those companies’ terms of use.
  
  
• If user (or organization) is involved in any litigation with KAM any user (or organization) license agreement with KAM is terminated, and is no longer valid and contnued use is considered a breach of contract. No refund will be offered.



• In the case of any parts of this agreement are found invalid, all other parts of the agreement shall remain in full force.

Site Usage and Warranty policy
• Software updates are a free download for one year after software or maintenance plan purchase.



• KAM makes every effort to ensure that the information is accurate on this site. However if you find that information is incorrect, please contact us and let us know.



• KAM make no representations about the suitability of the information contain in documents, web pages, messages on this site, source code samples, software programs and related material published as part of the services for any purposes. All documents, web pages, messages, source code samples, software programs and related material are provided “AS IS” without warranty of any kind.



• KAM herby disclaim all warranties and conditions with regard to this information, including all warranties and condition of merchantability, where express, implied, or statutory, fitness for a particular purpose, title and non infringement for any basis. In no event shall KAM be liable for any special, indirect or consequential damages whatsoever resulting from the loss of use, data or profits, whether in an action of contract, negligence or the tortuous action, arising out of or in connection with the use of information available from the services on this site or products we provide.
All software programs, and tips downloaded from this site are with no warranty and are sold or supplied AS-IS.


• Some products sold by KAM come with a limited warranty or software license provided by a third-party manufacturer or vendor. All merchandise which does not include a warranty and/or software license by the manufacturer, vendor, or KAM and is sold AS IS, without warranty.

Applicable Law
• This Agreement is governed by the laws of the state of Oregon and the United States, including patent and copyright laws. Any claim arising out of this Agreement shall be brought Federal Court in Portland, Oregon. All parties agree that personal jurisdiction is proper in Portland, Oregon.
